DPE: all you need to know about the change and the terms and conditions
The energy performance diagnosis (DPE) is a document which announces to the future owner or tenant, an estimate of the energy consumption of the dwelling as well as its rate of greenhouse gas emissions. Since July 1, 2021, it has become mandatory and engages the responsibility of the current owner. Important changes to note: The method of calculating the DPE is now the same for all dwellings. It integrates new criteria (in addition to the building, the quality of the insulation, the types of windows and the heating system) such as the energy consumption of lighting, ventilation or even thermal phenomena. For collective housing, the DPE can concern the entire building and benefit all its owners. If the latter undertake work in their apartment, they can however replace it with an individual DPE. If the buyer or tenant has any doubts about the diagnosis of the current owner, he can make a new one. If it does not display the same data, the person can turn against the owner by asking for compensation, or even appeal to justice. The presentation of the DPE now shows the theoretical amount of the energy bills as well as additional information. The thresholds displayed on the energy labels (from A to G) are calculated according to primary energy, but also greenhouse gas emissions. The worst performance will define the class of the accommodation. From 1 January 2023, the maximum final energy consumption threshold for a dwelling will be 450 kWh/m². Beyond this threshold, the accommodation will be considered indecent. Prohibition on the rental of “energy strainers” housing Taking into account all these developments, housing with high energy consumption and deemed indecent, also called “energy strainers”, will be prohibited from rental from 2023, according to the Government. The Climate and Resilience Bill aims to ban the rental of all thermal colanders in 2028. This decision aims to: Reduce our greenhouse emissions Protect tenants from excessively high energy bills Allow time owners to carry out renovation work It will also be prohibited to increase the rent of classified F and G dwellings at the time of lease renewal or re-letting. The Ministry of Housing estimates the number of “thermal sieve” dwellings at 4.8 million in the territory, which is twice less than the figure announced by the FNAIM (National Federation of Real Estate). A figure that has been constantly increasing since the change in the method of calculating the DPE. These accommodations are numerous in Paris, so this will lead to a significant drop in the number of accommodations offered for rent. Cities will be faced with “a problem of supply and availability” according to the president of the FNAIM, Jean-Marc Torrollion.
